By downloading or using NXT (the “app”), you agree to these Terms of Use. If you do not agree, please do not use the app.

Licence

We grant you a personal, non-transferable, non-exclusive licence to use NXT on devices you own or control, for your personal, non-commercial use, subject to these terms and to the Apple Media Services / App Store Terms of Service.

Purchases

NXT is free to use for a limited number of completed workouts, after which a one-time purchase unlocks unlimited use. This is a one-time purchase, not a subscription. All purchases are processed by Apple and are subject to Apple’s terms. Refunds are handled by Apple in accordance with their policies; we are unable to issue refunds directly.

Health & fitness disclaimer

NXT is a tool for tracking workouts and suggesting weights and repetitions. It is not medical or professional fitness advice. Consult a qualified physician before beginning any exercise programme. You are solely responsible for exercising safely, choosing appropriate weights, using proper form, and stopping if you feel unwell. You use the app and follow any of its suggestions at your own risk.

No warranty

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not guarantee that the app will be uninterrupted, error-free, or that your data will never be lost. Please keep your own records of anything important to you.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any injury, loss of data, or other loss or damages arising out of or in connection with your use of the app.

Changes

We may update these terms from time to time. Your continued use of the app after changes are posted means you accept the updated terms.

Governing law

These terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict-of-law principles.
